DE LIMA TELLS SC SHE'S NOT DISOBEDIENT


MANILA - Justice Secretary Leila De Lima has submitted to the Supreme Court her compliance with its show cause order on why she should not be cited in indirect contempt of court for failure to comply with a TRO the high court issued last November 15 on the travel ban against former President Arroyo and her husband, Mike.

In her 17-page compliance submitted today, De Lima asked the high tribunal to declare her "innocent of the charge."

The show cause order was anchored on two grounds: refusal to comply with the temporary restraining order (TRO), and "disrespect" to the high court.

De Lima pointed out in her compliance that the TRO was not effective on the day it was issued since the Department of Justice (DOJ) and the Bureau of Immigration (BI) were not served an official copy of the order.

On the same day the TRO came out, the former first couple attempted to leave the country but were barred by immigration officials in what has been described as a "circus" at the Ninoy Aquino International Airport (NAIA) 1.

"[T]he prevailing rule is that a TRO is effective only upon service to the party or person sought to be enjoined," De Lima's compliance read.
